Complaint/Violation

Trees taken down, stone wall disturbed

J. Teachout explained that in 2006 the Desruisseaux’s purchased a 40’ strip piece of land from the neighbor that goes from one lot to another. They were clearing the land to allow their horse and cows to pass through each area. The new owners want to run an electric fence along the property line to stop the animals from going onto abutter’s property. The existing stone wall was rebuild/replaced in two areas and some of the brush was removed. The PVC pipes, installed by Holland Shaw, have been in the ground a long time and are filled with silt. There was work done within the 100’ buffer zone and the owner cleaned out the debris and brush from the stream. The channelization of the intermittent stream was not changed,
but there were trees in the stream that were pulled out.
M. Briggs replied if they have taken down any trees 5’ and over the trees need to be replaced.
The Board will review the plans.
Abutter:
Patricia White, 27 Douglas Road, is concerned with her stone wall, and said she spoke with Ms.
Teachout about the repair of the stone wall.
The Board will do a site visit on October 11, 2008 at 9:00am, and continue this hearing on October 15, 2008.
Erosion/Siltation Concerns

Nicole Sanford, Stantec Environmental Scientist, Robert Judson, Wilkinsonville Water District (WWD)
N. Sanford reviewed the letter received by Atlas Box on the repair of a wash out on their property. She stated they don’t know why the erosion occurred, or when or where it started. The property lines that are shown on the plans were reviewed according to where the erosion occurred.
Wilkinsonville Water District will fill in the eroded area and seed for prevention of further erosion. They tried to contact Worcester Sand and Gravel, several times, but received no answer.
Atlas Box has a plan to stop the water and silt with a detention pond and headwall.
R. Judson said the WWD would fill in with a gravel mix, but is concerned as to where Atlas Box is going to excavate during their construction.
M. Briggs told both Atlas Box and WWD to carry on with their plans to help stop this erosion. The Commission will continue to try and contact the Worcester Sand and Gravel also.
J. Sheehan also suggested they carry on and if necessary and emergency certificate can be issued for this activity, to do this work without them having to come back to a meeting.

The project consists of construction of a small propane storage and distribution facility, Land clearing, minimal earthwork, one aboveground storage tank, fencing, and aggregate roadway, and installation of a waterline in Providence Road.
Present: Alton Stone, Alton Engineering, Paul Dileo, Dileo Gas Inc., Frank Reno, owner, Dave Lavallee, surveyor.
Alton Stone reviewed the site visit information from October 11, 2008. The Commission requested, on the plan, as to which trees are coming down and what would be replanted. Some trees would be used to screen the entrance way on the side coming from Millbury. 17 Stems (trees) would be taken down. They propose to replant 22 trees, which include the five trees to be used for screening purposes along the road and Millbury side of the property. Mr. Stone did research as to why this is not in the 100’ buffer zone of the riverfront area. He spoke with Heidi Davis, from the North East Division of Environmental Protection. She stated two points to look for. One to check the flow of the river and two, if they use banks full conditions as the estimate of the high water
line where wooded vegetation begins, that is the bank full condition. Swamp or shrub swamp is used as the riverfront characteristics if the area has riverine characteristics.

BOARD BUSINESS
The Board reviewed the Hough Road Van Dyke Park – Sutton Youth Baseball information.
A letter would be sent to 20 Grace Ave/Donavan Realty for trees cut and trees to be replant.
A second Site Visit will be done for 17 Davis Circle to review the area for the three trees that were to be replanted so the Commission to be able to sign the Certificate of Compliance at the next meeting.
Site Visits for a Certificate of Compliance will be done for both 26 Irma Jones Road and 97 Singletary Ave.
A Determination of Applicability was signed for the 50 McClellan Road project.
The Board signed the Order of Conditions for: 9Maple Street, 65 Stone School Road, and Main Street/Route 146
A final review was done for the Order of Conditions on 66 Wilderness Road, before mailing out.
The Board signed an Amended Order of Conditions for the 171 Worc. Prov. Tpke/Lowes project.
